While WHEN can stand for Winning for Health & Earth Now, it is primarily a call to action. Our name reflects the urgency of addressing corporate harm and our belief that accountability shouldn't have to wait.
WHEN is NOW.
Yes. WHEN Justice is a U.S.-based 501(c)(3) nonprofit organization dedicated to counterbalancing corporate power and protecting human and environmental health.
No. WHEN Justice is a nonprofit organization that supports public-interest legal action through funding and strategic partnerships. We work with independent attorneys and legal organizations to advance cases that protect human and environmental health, but we do not provide legal representation or act as counsel in the cases we support.
There are many ways to get involved, whether you're an individual or an organization. You can donate, share our work, attend events, or help bring greater attention to the issues we're addressing. We also welcome opportunities to collaborate with legal organizations, nonprofits, researchers, philanthropists, and other partners committed to advancing corporate accountability.

Donations designated for the NOW Fund support that specific program, including the resources and activities necessary to advance its work.
We welcome conversations with donors interested in supporting a particular issue, program, or area of legal action. Our team can help explore opportunities that align with your philanthropic priorities and WHEN's mission.
Yes. Contributions to the NOW Fund support both legal action and the infrastructure needed to advance it, including case identification, due diligence, grant administration, and ongoing oversight.
Our founder is currently matching every donation until we reach $2 million. This means that for every donation you make (whether it’s to a campaign or to WHEN Justice), an equal amount from the match fund is added to the campaign — effectively doubling your impact. All matching donations are subject to applicable payment processing fees.
Yes! Many employers match charitable donations made by their employees, potentially doubling or even tripling the impact of your gift. Check with your employer to see if WHEN Justice is eligible for its matching gift program.
Absolutely! Matching gifts are a powerful way to inspire others to give and multiply the impact of your support. If you're interested in sponsoring a matching gift opportunity for the NOW Fund or another area of WHEN's work, please contact rafael@whenjustice.org to explore the possibilities.

Yes. You’ll receive an instant payment confirmation from Stripe, and within 24 hours WHEN will also email you an IRS-compliant donation receipt for your records and tax purposes.
A recurring donation is an automatic monthly or yearly contribution that provides consistent funding for WHEN Justice’s work. Your donation will be charged to your selected payment method each month until you choose to update or cancel it.
You can support the NOW Fund with a recurring monthly donation, providing reliable funding to advance legal action as new opportunities arise. Simply select the monthly giving option when making your donation.
Your recurring donation will be charged on the same day of each month or year as the date you enrolled. For example, if you start your monthly donation on the 15th, future donations will be processed on the 15th of each month. If your recurring donation is scheduled for a date that doesn’t occur in a particular month (such as the 31st), your donation will be processed on the last day of that month. For example, a donation scheduled for January 31 will be charged on February 28 (or February 29 in a leap year), then on March 31, April 30, and so on.
Yes. You can update your recurring donation amount at any time through your donor account.
Yes. You can update your payment method, billing information, or other payment details at any time through your donor account.
You can cancel your recurring donation at any time through your donor account. There are no cancellation fees or penalties. Once canceled, no future payments will be processed. Previous donations will remain in your donation history and are not affected by the cancellation.
The NOW Fund primarily covers scientific testing, technical analysis, and expert costs needed to investigate environmental health harms and support litigation. Eligible expenses may include environmental sampling, laboratory testing, air and water quality monitoring, consumer product testing, expert witness fees, and related expert costs, including travel and depositions.
The NOW Fund does not cover attorney fees, routine court costs, general operating expenses, or unrelated advocacy and communications activities.
Most NOW Fund grants range from $10,000 to $100,000. We may consider requests outside this range, although exceptions may be less likely to receive funding.
Funding may support work before a lawsuit is filed or during litigation, including discovery. Previously incurred testing and expert expenses may also be eligible when properly documented.
While early-stage investigation is a priority for the NOW Fund, applicants must have legal representation or have consulted an attorney about how the proposed work could inform legal action.
Yes. Organizations that receive funding for early-stage investigation may apply for additional support as their cases progress, including funding for expert witnesses during discovery.
Each request is evaluated independently. Previous funding does not guarantee additional support.
The NOW Fund supports litigation that holds corporations and other responsible parties accountable for environmental and human health harms.
We prioritize cases where scientific testing, technical analysis, and expert evidence can help establish the facts, strengthen legal claims, and improve the potential for meaningful outcomes.
For more information about the types of cases we fund, visit our page.
The NOW Fund accepts funding requests from U.S.-based nonprofit organizations, community groups, and law firms pursuing eligible cases anywhere in the United States.
We do not fund individuals representing themselves in court.
The NOW Fund considers class actions and appeals involving eligible environmental enforcement or liability claims.
As with other funding requests, support is focused on qualifying scientific testing, technical analysis, and expert costs.
The NOW Fund primarily supports enforcement and liability cases where new scientific evidence and expert analysis can play a meaningful role.
We generally do not fund standalone challenges to government permits, regulations, or other agency decisions, which are often decided based on an existing administrative record.
Exceptions may be considered when these proceedings are part of a broader enforcement or liability strategy.
The vast majority of WHEN’s funding is intended to fund cases that at least have the potential to recover costs, either through judgment or settlement. WHEN makes exceptions to this at our discretion.
If a case does not result in monetary recovery, the Pay-it-Forward Grant is forgiven, and no repayment is required. For cases without the potential for monetary recovery, WHEN may provide direct grants that do not require repayment.
No. Grantees and their legal counsel retain full control over their cases, including litigation strategy, expert selection, and settlement decisions.
WHEN provides funding for agreed-upon expenses and receives updates on the progress of funded work, but does not exercise control over litigation decisions.
